Chane Socarras PLLC Victory in Contract Litigation Affirmed by 11th Circuit Court of Appeals
February 24, 2021
The United States Court of Appeals for the Eleventh Circuit has recently affirmed a final judgment for $2.1 million obtained by Chane Socarras PLLC trial attorneys, Ruben E. Socarras, Jonathan Chane and Nicole Oden for their affiliate network client. In the appeal, handled primarily by Ruben E. Socarras and appellate co-counsel Warren Kwavnick of Cooney Trybus Kwavnick Peets in Fort Lauderdale, the 11th Circuit upheld the trial court’s entry of summary judgment and dismissal of the opposing parties’ counterclaims resulting in the final judgment.
The case arises from a contentious contractual dispute involving the defendants’ violations of a settlement agreement in which the parties had resolved previous commercial litigation stemming from the an advertiser’s nonpayment of the network’s services and violations of a marketing agreement. After more than three years of litigation, the lower court ruled in favor of the affiliate network finding that the advertiser was responsible for the full amount due from the previous litigation, prejudgment interest, and prevailing party attorneys’ fees and costs.
