Chane Socarras Prevails in Two-Day Bench Trial Enforcing Commercial Services Agreement for National Hospitality Services Company

BOCA RATON, Fla. – Chane Socarras, PLLC is pleased to announce a successful trial result on behalf of a national hospitality janitorial services company, following a two-day non-jury trial in the Circuit Court for Palm Beach County, Florida.

Founding Member Ruben E. Socarras and Litigation Associate Attorney Jafar M. Abuyounis successfully represented their client for nearly two years in a breach of contract action arising from the early termination of a commercial janitorial services agreement by the operator of a large hospitality and dining food hall in Miami, Florida.  As a result, the Court entered judgment in favor of firm’s client, as the plaintiff, for compensatory damages, together with prejudgment interest, and determined that the client is entitled to recover its reasonable attorneys’ fees and taxable costs pursuant to the parties’ agreement.  In doing so the Court also ruled against and dismissed the Defendant’s counterclaims.

“This case underscores the importance of carefully drafted commercial agreements and enforcing them according to their terms,” said Ruben E. Socarras. “Businesses often assume they can withhold payment based upon perceived performance issues, but Florida law and the parties’ contract required timely payment and compliance with negotiated notice-and-cure procedures before taking such action. We are pleased the Court enforced those contractual provisions as written.”

The case highlights several important principles of Florida commercial litigation, including the enforcement of contractual notice-and-cure provisions, the doctrine of first material breach, substantial performance, and the enforcement of contractual remedies arising from the wrongful early termination of a commercial services agreement, including contractual early termination fees.
